Reservation and Payment of Rentals
Silverglades LLP Holiday Homes, Dalnabay, Aviemore PH22 arrange bookings of holiday accommodation as Owners of such properties. The use of any property is subject to the terms and conditions of booking as outlined below. When you book your holiday with us you are entering into a contract, which binds you, and us in various ways. You’ll see we have clearly set out the booking conditions with a list of responsibilities and commitments you and we have towards each other.
Terms: All terms are for the accommodation requested and equipped as described for use as holiday accommodation only, for the number of nights booked and for the stated maximum number of persons only. If more than the maximum number of persons are in a holiday home we have the right to terminate the contract immediately without refund. The usual time of take over is 4.00pm (subject to unavoidable delays). You must leave your Holiday Home by the time stated on your hire letter (10.00am). You are obliged to leave everything in a clean and tidy condition. You are responsible for any damage done or loss sustained during your stay.
Prices quoted in our brochures and other literature includes VAT at the rate applicable at the time of printing and are subject to change if the rate or application of the tax changes. In the event of a change in the rate of VAT during the course of the year, your holiday will be invoiced at the new amount of VAT unless you have already taken your holiday or paid the balance in full prior to the date of change. Our hire letter and booking acceptance is not a VAT invoice. We reserve the right to correct errors in advertised prices. We will advise you of any error at the time of booking. We also reserve the right to correct errors in confirmed prices. In this case, we will contact you as soon as we become aware of the error. If the correct price is higher and you do not wish to pay this, you will be entitled to cancel and receive full refund of all monies you have paid to us providing you notify us within 14 days of our advising you of the error. We promise we will not seek to correct any error in a confirmed price within 8 weeks of the start date of you holiday or more than 7 days after you make your booking whichever is later.
A binding contract between you and us will come into existence when we issue your confirmation of deposit letter. The contract shall be deemed to have been made at our offices in Aviemore and be subject to Scottish Law. We both agree to submit any dispute to the exclusive jurisdiction of the Courts of Scotland. In all cases these Conditions of Hire form the basis of your Contract.
3 star Silverglades Standard - Your booking will only be confirmed on receipt of a security deposit £50/£100 stated at the time of booking, which is used as a breakage bond and for electricity used during your stay, only switch or credit card debit. If no deposit received within 5 days of booking we will cancel the booking without notification. If you cancel your booking at any time this Confirmation Deposit is non refundable.
Payments by credit card are subject to a 2.5% surcharge; payments by debit card do not incur a surcharge if the card is issued by a UK bank. The Company accepts Visa and MasterCard; Maestro (formerly Switch); Visa Delta; Visa Electron and American Express.
4 Star Silverglades Select - 'Your booking will only be confirmed on receipt of a deposit payment of 25% of the tariff. Final balance payments will be due 8 weeks prior to arrival. An additional amount of £50 will be required as a good house-keeping deposit and will be taken as part of the initial deposit payment. The good house-keeping deposit will be refunded within 5 days of departure subject to there being no breakages or damage to property. If no deposit received within 5 days of booking we will cancel the booking without notification. If you cancel your booking at any time this Confirmation Deposit is non refundable.
Telephone bookings will normally be held as provisional bookings for up to 5 days only out with high seasons and up a maximum of 24 hours within high season and MUST be confirmed by credit card or post immediately. All sterling cheques must be payable to Silverglades Holiday Homes. Payment by sterling cheque or Debit or Credit card is not considered to be confirmed until it has cleared at our Company Bank. Should a material change be made to any booking once the booking documentation has been issued an automatic administration fee of £10.00 will be levied. Any change of holiday dates is only possible with our agreement.
The Holidaymaker becomes liable for the full balance of the rental no later that two calendar months prior to arrival in resort. If we have not received the full outstanding balance by the due date, an overdue reminder telephone call will be made or an overdue letter will be issued to the holidaymaker and a charge of £10.00 will be added to the balance due. Where the full outstanding balance is still not received within a further 72 hours or 3 working days, we reserves the right to cancel the holiday booking and may retain the deposit paid by the holidaymaker. The holidaymaker shall have no claim against us for compensation or reimbursement whatsoever.
Should a booking be made within two calendar months of arrival, full payment must be made at time of the initial booking. No accommodation can be provided unless full payment is received by the due date and this applies whether the holiday is a direct reservation or through another Travel Agency or other UK or Overseas Referral Agency.
Cancellation by You: Telephone us IMMEDIATELY if you have to cancel your holiday. Then on the same day send us by first class mail written cancellation. If you cancel more than four weeks prior to the start date of your holiday we will refund any Balance of Hire monies paid in full and you will only forfeit your Confirmation Deposit. If you can between four and two week of the start date of your holiday you will be liable for 50% of the Balance of Hire monies. If you cancel within two weeks of the start date you are liable for the entire Confirmation Deposit and Balance of Hire monies. Holidaymakers are strongly recommended to take out holiday insurance to cover cancellation, loss or damage to personal effects. We insure our properties against fire etc; but under no circumstances can we be held liable for any loss or damage to holidaymaker’s property.
Period of Let: Tenancies begin at 4pm on the day of arrival and end at 10.00am on day of departure. Any early arrival or delayed departure may incur additional charges at discretion. Where late arrival is planned it is essential that you notify us at least 24 hours in advance. No responsibility will be accepted for any arrivals out with normal office hours where prior arrangements have not been confirmed for out of office key collection. Any Holidaymakers who have lost or not returned property keys to our office within TWO HOURS after the due time for departure will be held liable for a £125.00 per door fee incurred in having replacement keys cut.
The Tenancy: The number of persons occupying a house must not exceed the number for which the accommodation has bee booked. We reserves the right to terminate the contract with no refund, or levy an extra charge in the case of a larger number of persons than approved using the accommodation or may terminate the rental period because of unreasonable nuisance behaviour or damage to the property. The Holidaymaker must allow us access to the property at any reasonable time during the period of the holiday.
You must notify any shortcomings with your Holiday home to the site office representative immediately so that remedial action, if appropriate, can be taken. We cannot accept subsequent claims for shortcomings not so notified and are unable to enter into correspondence with guests who have failed to register any dissatisfaction to our offices whist resident in their chosen holiday accommodation. Any operational failure of appliances must be reported to the site office representative immediately. Where appliance cannot be repaired within 48 hours, a substitute appliance will be provided where possible, however, we cannot guarantee the availability of a substitute appliance. We will not be liable for any loss or damage resulting from incorrect operation of any appliance but a domestic engineer will test machine. For all complaints and claims which do not involve personal injury, illness or death, we regret we cannot accept any liability if you fail to notify us on any complaint or claim during your holiday and write to us with full details within 28 days of the end of your holiday. Any damage to property, fixtures or fittings will be deducted from your deposit. If in excess of deposit, cost will be deducted from credit or debit card automatically. Invoices can be produced. All deposits shall be returned once property has been checked normally within 7 days, less cost of electricity, extra cleaning, or damage or lost items.
‘Force Majeure’: We cannot accept responsibility or pay compensation where the performance or prompt performance on our contract with you is prevented or affected by reason of circumstance, which amount to Force Majeure. Circumstances amounting to Force Majeure include any event which, we could not, even with all due care foresee to avoid. Such circumstances include the destruction or damage of your Holiday Home (which cannot reasonably be remedied to a satisfactory standard before the start of your holiday) through fire, flood, explosion, storm or other weather damage, break-in, criminal damage or any similar event beyond our control. Such circumstance also include riots or civil strife, industrial action, natural or nuclear disaster, fire, adverse weather conditions, war or threat of war, actual or threatened terrorist activity and all similar situations beyond our control.
Single-sex group bookings: We cater primarily for family holidays but we do allow single sex groups, if notified to us when booking. A person booking for such a party may be asked to pay an additional security deposit and will be held accountable for the group’s actions in holiday accommodation.
Wheelchair/Disabled Users: If you have someone in your party who is in a wheelchair, please let us know and we will try to make our specially equipped bungalow available to hire. If this is not available we can provide portable ramps at front and back door for guests.
Pets: Pet(s) are accepted in some properties where an additional fee of £45 per week per pet is levied, max 2 pets. All pets must be kept under control at all times and must not be left alone in any property at any time. Any damage or additional cleaning required both inside and out the property is payable by the Holidaymaker. No pet(s) are allowed in bedrooms or on furniture.
Lost Property: Should any property be left in our properties we will endeavour to return any items to their respective owners. Please note an administration charge of £5.00 is levied, plus postage and packing, payable in advance by debit card or cheque. Any items not collected within 28 days will be disposed off.
Your Vehicles: Each bungalow has its own hard standing parking area, which must be used. Vehicles should not be left on the road and they, their accessories and contents are left at your own risk. We cannot be held responsible for loss or damage thereto from any vehicle except through proven negligence of our staff.
Availability: Your booking is accepted on the understanding that your confirmed Holiday Home will be available for your use on the agreed date. Very occasionally ‘Force Majeure’ does not make this possible. Where ‘Force Majeure’ arises, we have the right to cancel your booking. In this event, we will endeavour to offer you an alternative Holiday Home, if available. If we cannot do so or if you do not wish to accept the alternative we offer, we will refund all monies you have paid in full. Where any cancellation or charge results from ‘Force Majeure’ our liabilities are limited to offering you an alternative property (where available) or full refund as set out above. We regret we cannot pay any compensation or meet any expenses or costs you may incur as a result of any such cancellation or charge.
We have the right to refuse to hand over accommodation to any person(s) who, in our reasonable opinion is not suitable to take charge of it. In such cases, all hire charges paid will be refunded in full, the contract shall be terminated and we will have not further liability.
If, in the reasonable opinion of ourselves, any person(s) is not suitable to continue the holiday because of unreasonable behaviour, damage to property or danger or significant annoyance to others, the Contract may be terminated, in which case we will not have further liability. In this event, you will remain liable to pay the hire price and no refund shall be due. You will also be liable for any damage caused in the Holiday Home. We have the right to enter any accommodation (without prior notice if this is not practical or possible) if special circumstances or emergencies arise (for example if repairs need to be carried out).
We have inspected all of the properties described in this brochure and have tried to ensure that the information given is accurate but we cannot be held responsible for inaccuracies or misrepresentations however they may have occurred. All information contained in the brochure is believed correct at the time of printing but we reserve the right to make alterations to prices and details at any time without notice but shall endeavour to inform the Holidaymaker of any such alterations.
Liability: Except where otherwise specified in these Conditions of Hire, we cannot accept liability for any damage, expense, injury death or loss of any nature whatsoever suffered by any persons from any cause whatsoever other than, in he case of proven negligence of our staff. All our guests are encouraged to ensure that they have adequate property and accident insurance for their holiday.
Call-out: There is an emergency call out number displayed on the reception window. Please note this is for Emergencies i.e. no power, fire, flood or theft.
